If You are a minor and wish to use the Software, You may do so only through Your legal guardian, and Dayspring Technologies Private Limited reserves the right to terminate Your account upon learning that You are a minor using membership of the Software. You are solely responsible for protecting the confidentiality of Your username and password, and any activity under Your account will be deemed to have been done by You. In the event that You provide Us with false or inaccurate details, or Dayspring Technologies Private Limited has reasonable grounds to believe that You have done so, We hold the right to permanently suspend Your account. The services that Dayspring Technologies Private Limited provides to You are subject to these Terms of Service. In the event of any change to the pricing or fee structure, existing Users will be intimated of the same, and it will be up to You to decide whether or not You wish to continue with the services offered by Us. Such changes are effective from the date they are intimated to You or from the start of Your next billing cycle, as applicable. The Software is accessed online through a web browser; no separate installation of downloadable software is required. To provide the Services, Bloom connects to and processes data from third-party platforms that You authorise, including Shopify and any advertising, payment or analytics platforms You choose to integrate. By connecting such a platform, You represent that You are authorised to grant Us access to that data and You permit Us to access, retrieve, store and process it for the purpose of providing the Services to You, in accordance with the Privacy Policy. Your use of any third-party platform remains governed by that platform’s own terms and policies. We are not responsible for the availability, accuracy or practices of any third-party platform, and We are not liable for any change a third party makes to its services, application programming interfaces (APIs) or data access that affects the functioning of the Software. In case of a dispute, the matter will first be attempted to be resolved by a sole mediator who is a neutral third party, selected by mutual acceptance of a proposed mediator by both parties. Either party may propose a name for the sole mediator, and where both parties accept the proposed name, that person shall be appointed sole mediator. If the parties are not able to reach a consensus within two proposed mediators, the Company reserves the right to decide who the final mediator will be. The decision of the mediator is not binding on the parties; however, the parties will in good faith attempt to abide by the decision.
In case of a dispute, the matter will first be attempted to be resolved by a sole mediator who is a neutral third party, selected by mutual acceptance of a proposed mediator by both parties.
